There seems to be many myths and misunderstanding amongst the general public and in fact the gullible get carried away with the name DPS without understanding the difference between DPS Society and DPS Trust. We at Strategum aim to present some of the facts and clear understanding on the issue for the benefit of parents and investors.
Delhi Public Schools
DPS is a chain of Schools in India and abroad with reputation for quality school education. The first DPS was started in Mathura Road in 1949 under the aegis of Delhi Public School Society. Today, there are more than 140 DPS Society Schools. The excellent reputation of DPS schools is testified by the inclusion of 19 DPS primary-secondary headed by DPS, R.K. Puram, Delhi in the EW-C fore India’s Most Respected Schools Survey 2011 league table. Currently 300 affiliation applications from educators are pending consideration of the DPS Society. Most investors in school education space vouch for the DPS Brand as it is the most probable brand name to attract students / admissions right from Year 1. We have generally seen admissions cross 600 students right in first year when a new school starts in name of Delhi Public School. Indeed, the brand that was painstakingly built over 60+ years has built enormous trust with the parents and society that they blindly take admission into DPS.
However, since last few years there is a legal battle being fought between the DPS Society and DPS Trust over the name “Delhi Public School”, “DPS”, its logo and right to award franchise / license.

The Legal Battle between DPS Society and DPS Trust
The DPS Society is a non-profit, non-proprietary, private, educational organisation with a global network of over 140 English medium, co-ed schools providing education from Pre-Nursery/Nursery to Class XII. It has been working for the last over six decades.
On the other hand, the DPS Trust was formed in 2003. When it began offering franchise to open schools under the brand name of DPS. The DPS Society moved the Delhi High Court seeking restraint on use of its name and logo.
In his order, Justice HR Malhotra observed that despite being registered in 2003, the Trust claims its foundation for 54 years and had been fraudulently using the logo which is ‘exactly similar’ to DPS Society.
Basing on the facts placed before the Court, Justice Malhotra restrained the Trust and its associates from using the name, Delhi Public School and the logo till further orders. The complete proceedings & details about Case at Delhi High Court can be verified with the ref No CS (OS) No 1518/2008.
According to Hindustan Times report, The Delhi high court on September 17, 2012 restrained DPS Trust’s running 27 schools across the country from using the name and logo of Delhi Public School. The report further says that Justice Kailash Gambhir said he would punish the secretary of the Delhi Public School Trust for contempt of court if it did not stop using the DPS name and logo with immediate effect. The court was all the more angry as the Trust had not complied with its order issued in 2008 mandating it not to use the DPS name and logo. Secretary of the Trust RS Parasar had even apologized to the court in 2008 and assured it that the DPS name and logo will not be misused.
The matter would come up for next hearing on 07th December 2012.
